Enforcement Action in Hyndburn
The Council always works with residents to manage their waste. However, enforcement action will be taken against those who
- drops or deposit litter
- fails to present their waste in their wheeled bin
- allows waste to accumulate on their property
- fly-tip waste.
Authorities now have the power to issue residents with a £75 fixed penalty notice for dropping litter on the street and out o vehicles. Anyone caught dumping waste in a litter bin can also face a fine up to £1,000.
If you present waste at the side of you wheeled bin, you will be issued with a fixed penalty notice and/or a legal notice under Section 46 of the Environmental Protection Act 1990, which can lead to fines of up to £1,000.
If you allow waste to accumulate on your property, e.g. dirty back yard, you will be served a legal notice under Section 80 of the Environmental Protection Act 1990, which can lead to fines of up to £5,000.
If you deposit, knowingly cause, or knowingly permit the dumping of waste, in or on land that does not have an environmental permit, you will be committing an offence under Section 33 of the Environmental Protection Act 1990, which can lead to fines of up to £50,000.
All residents are bound by a duty of care under Section 34 of the Environmental Protection Act 1990. You must ensure your waste is properly deposed of at a licensed facility, i.e. the household waste recycling centres. This includes any waste you may pass to a third party for disposal on your behalf.
