Guidance on Contaminated Land

Under part IIA of the Environmental Protection Act 1990 , Local Authorities are required to develop a contaminated land Strategy.

Our team investigates land within the Borough prior to redevelopment to determine whether there is a risk of that land being contaminated.

This is done through a risk assessment which addresses;

  • Previous land use
  • Works carried out to clean the land in the past
  • Current land use
  • The likelihood of the land being affected by pollutants

Hyndburn Borough Council has not yet determined any land in the Borough as Contaminated under Part IIA of the Environmental Protection Act 1990.

The Planning Policy Statement Note 23:Planning and Pollution Control
outlines the various roles and responsibilities when developing land potentially affected by contamination.

Where development or redevelopment is proposed, the developer is resposible for ensuring that it is safe with regards to the purpose for which it is intended.

If necessary, remediation work can be undertaken to make land safe.
