Criteria for Fit and Proper Person and Standard Licence Conditions

Before the Council can issue a licence they must be satisfied that the licence holder is ‘fit and proper’ and satisfactory management arrangements are in place. The criteria for determining this can be downloaded below.

Section 90 of the Housing Act 2004 imposes certain mandatory conditions which the Council has no discretion to vary and it gives the Council the power to include such conditions it considers appropriate for regulating the management, use or occupation of the house concerned.

A person who breaches a condition of a licence may be liable upon summary conviction to an unlimited fine. As an alternative to prosecution, the Council may impose a civil penalty of up to £30,000 for this type of offence.
